The Standing Senate Committee on Legal and Constitutional Affairs, met this day, in Room 505, Victoria Building at 1:00 p.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the committee present: The Honourable Senators Anderson, Beaudoin, Carstairs, Doyle, Jessiman, Kenny, Lewis, Milne, Nolin, and Pearson (10).

Other senator present: The Honourable Senator Kinsella (1).

In attendance: Laura Snowball, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

Professor William Schabas, Université du Québec à Montreal.

From the Canadian Tobacco Manufacturers' Council:

Mr. Robert R. Parker, Chairman and Chief Executive Officer;

Mr. Colin Irving, Legal Counsel, RJR-Macdonald Inc.;

Mr. Simon Potter, Legal Counsel, Imperial Tobacco Limited;

Mr. Stephen Sofer, Legal Counsel, Rothman's, Benson & Hedges Inc.

Pursuant to the Order of Reference adopted by the Senate on Thursday, March 13, 1997, the committee continued its consideration Bill C-71, An Act to regulate the manufacture, sale, labelling and promotion of tobacco products, to make consequential amendments to another Act and to repeal certain Acts. (See Issue No. 50, Wednesday, March 19, 1997, for full text of Order of Reference .)

The Chair made an opening statement.

Senator Jessiman asked a question of the Chair.

Professor William Schabas made a statement and answered questions.

At 2:20 p.m., the committee suspended.

At 2:26 p.m., the committee resumed.

The Chair made a statement.

Mr. Robert R. Parker made a statement.

Mr. Colin Irving made a statement.

Mr. Parker, Mr. Irving, Mr. Potter and Mr. Sofer answered questions.

Mr. Parker agreed to ask member companies whether they had conducted any studies on the relationship between sponsorship, sponsorship advertising and smoking consumption and, if so, provide copies to the committee, as long as the studies are notconfidential.

Mr. Irving agreed to provide to the committee a copy of the Smee study on the causes of youth smoking.

Mr. Parker agreed to provide to the committee a copy of a report by Conrad, Flay and Hill, on the causes of smoking.

Pursuant to the decision of the committee on March 20, 1997, the draft amendments by Senator Haidasz were tabled with the committee (Exhibit No. 5900 L1-C-71-52 "2").

At 4:38 p.m., the committee adjourned to the call of the Chair.
