The Standing Senate Committee on Legal and Constitutional Affairs, met this day, in Room 356-S, Centre Block at 9:02 a.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the ccommittee present: The Honourable Senators Carstairs, Corbin, Doyle, Gigantès, Jessiman, Landry, Lewis, Milne, and Pearson. (9)

In attendance: Marilyn Pilon, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

From the Canadian Bar Association:

Ms Tamra Thomson, Director, Legislation and Law Reform;

Professor Allan Manson, member, Committee on Imprisonment and Release, National Criminal Justice Section.

From the Department of Justice:

David Whellams, Counsel, Criminal Law Policy Section, Policy Sector.

Pursuant to the Order of Reference adopted by the Senate on Thursday, April 17, 1997, the committee continued its consideration of Bill C-55, An Act to amend the Criminal Code (high risk offenders), the Corrections and Conditional Release Act, the Criminal Records Act, the Prisons and Reformatories Act and the Department of the Solicitor General Act. (For full text of order of reference, please refer to Issue No. 60, Monday, April 21, 1997.)

The Chair made an opening statement.

Ms Tamra Thomson made a statement.

Professor Allan Manson made a statement and answered questions.

Mr. David Whellams answered questions.

At 10:50 a.m., the committee suspended.

At 10:55 a.m., the committee resumed.

It was moved by the Honourable Senator Lewis -- THAT the committee dispense with clause-by-clause consideration of Bill C-55.

The question being put on the motion, it was agreed, on division.

It was moved by the Honourable Senator Lewis -- THAT Bill C-55 be reported to the Senate without amendment but with one observation.

The question being put on the motion, it was agreed, on division.

At 11:15 a.m., the committee adjourned to the call of the Chair.
