The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 257, East Block, at 4:53 p.m., the Chairman, the Honourable Senator Lorna Milne, presiding.

Members of the committee present: The Honourable Senators Cogger, Doyle, Gigantès, Jessiman, Kinsella, Losier-Cool, Milne, Nolin, Pearson and Watt (9).

In attendance: Nancy Holmes, Research Officer, Research Branch of the Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

From the Canadian Human Rights Commission:

Ms Michelle Falardeau-Ramsay, Q.C., Chief Commissioner;

Mr. William Pentney, General Counsel, Legal Services Branch.

Pursuant to the order of reference adopted by the Senate on Wednesday, October 29, 1997, the committee continued its consideration of Bill S-5, An Act to amend the Canada Evidence Act and the Criminal Code in respect of persons with disabilities, to amend the Canadian Human Rights Act in respect of persons with disabilities and other matters and to make consequential amendments to other Acts. (See Issue No. 2, Thursday, October 30, 1997, for full text of Order of Reference.)

The Chairman made a statement.

Ms Falardeau-Ramsay made a statement and, together with Mr. William Pentney, answered questions.

At 6:12 p.m., the committee proceeded to the consideration of a draft budget.

The Honourable Senator Nolin moved -- That the following budget be submitted to Internal Economy for approval.

Professional and Other Services $ 22,900.00
Transportation and Communications 6,000.00
Other Expenditures 2,500.00

TOTAL $ 31,400.00

The question being put on the motion, it was agreed.

The Honourable Senator Gigantès moved -- That Senator Nolin act as Deputy Chairman in the absence of Senator Cogger.

The question being put on the motion, it was agreed.

At 6:22 p.m., the committee adjourned to the call of the Chairman.
