The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 257, East Block, at 3:47 pm., the Honourable Lorna Milne, the Chair, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Bryden, Buchanan, P.C., Fraser, Grafstein, Joyal, P.C., Milne, Moore and Pearson (9).

In attendance: David Goetz and Nancy Holmes, Research Officers, Research Branch, Library of Parliament.

Pursuant to the Order of Reference adopted by the Senate on Thursday, December 10, 1998, the committee continued its consideration of Bill C-40, An Act respecting extradition, to amend the Canada Evidence Act, the Criminal Code, the Immigration Act and the Mutual Legal Assistance in Criminal Matters Act and to amend and repeal other Acts in consequence. (For full text of Order of Reference please refer to Issue 60, Wednesday, March 10, 1999.)

The Chair made an opening statement.

The Honourable Senator Beaudoin made a statement.

The Honourable Senator Joyal stated he would abstain from voting on clause-by-clause consideration of Bill C-40.

The Honourable Senator Grafstein stated that he would also abstain from voting on clause-by-clause, if it proceeds today, suggesting that the committee hear from Mr. Edward Greenspan after the adjournment.

The Honourable Senators Bryden, Pearson, Fraser and Beaudoin each made a statement.

After debate,

It was moved by the Honourable Senator Fraser -- That the committee dispense with clause-by-clause consideration of Bill C-40.

The question being put on the motion, it was agreed, with Senators Joyal and Grafstein abstaining.

It was agreed that Bill C-40 be reported to the Senate, without amendment, Senators Joyal and Grafstein having abstained.

The Honourable Senator Grafstein made a statement asking that the abstentions be noted in the report.

After debate, it was agreed.

At 4:17 p.m., the committee suspended.

At 4:25 p.m., the committee resumed and proceeded to the consideration of a draft budget (1999-2000).

The Honourable Senator Beaudoin moved -- That the following budget be submitted to Internal Economy for approval.

Professional and Other Services $ 18,100.
Transportation and Communication 16,010.
Other Expenditures 2,550

TOTAL $ 36,660

After debate,

The question being put on the motion, it was agreed.

At 4:35 p.m., the committee adjourned to the call of the Chair.
