The Standing Senate Committee on Transport and Communications met this day at 11:02 a.m., in Room 256-S, Centre Block, to consider Bill S-23.

Members of the committee present: The Honourable Senators Buchanan, P.C., De Bané, P.C., Fitzpatrick, Johnson, Kenny and Poulin (6).

In attendance: June Dewetering, Research Officer, Library of Parliament and Till Heyde, Legislative Clerk, Committees and Private Legislation Directorate.

Also in attendance: The official reporters of the Senate

From the Department of Justice:

Lieutenant Colonel Dominic McAlea, Director of Law, International Law, Office of the Judge Advocate General.

From the Air Transport Association of Canada:

Jeffrey Elliott, Vice-President, Policy and Strategic Planning.

Pursuant to the Order of Reference adopted by the Senate on February 3,1999, the committee proceeded to consider Bill S-23, An Act to amend the Carriage by Air Act to give effect to a Protocol to amend the Convention for the Unification of Certain Rules Relating to International Carriage by Air and to give effect to the Convention, Supplementary to the Warsaw Convention, for the Unification of Certain Rules Relating to International Carriage by Air Performed by a Person Other than the Contracting Carrier.

The Clerk informed the committee that the Chair and Deputy Chair were unavoidably absent.

Pursuant to Rule 11, the Clerk of the Committee presided over the election of the acting Chair.

The Honourable Senator Fitzpatrick moved that the Honourable Senator Poulin be acting Chair of the committee for this meeting.

The question being put on the motion, it was adopted.

The witnesses made a statement and answered questions.

It was agreed -- That the committee complete clause-by-clause consideration of Bill S-23.

It was agreed -- That clauses 1 to 5 carry.

It was agreed -- That the preamble carry.

It was agreed -- That the Title carry.

It was agreed -- That the bill be adopted without amendment.

It was agreed -- That Bill S-23 be reported to the Senate today without amendment.

At 12:00 p.m., the committee adjourned to the call of the Chair.
