The Standing Senate Committee on Aboriginal Peoples met at 6:07 p.m., this day, in room 160-S, Centre Block, the Chair, the Honourable Senator Austin, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Austin, P.C., Christensen, DeWare, Gill, Nolin, Pearson, Rompkey, P.C., Sibbeston, St. Germain, P.C., and Tkachuk (11).

In attendance: From the Library of Parliament: Mary Hurley; From the Senate Committees Directorate: Josée Thérien, Legislative Clerk and Till Heyde, Committee Clerk.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, February 10, 2000, the committee continued its examination of Bill C-9, An Act to give effect to the Nisga'a Final Agreement. (See Issue No. 3, Wednesday, February 16, 2000 for full text of the Order of Reference.)

It was agreed -- That the documents from Wendy Lockhart Lundberg be filed as an exhibit with the committee (Exhibit 5900 A1/C-9, 9 "1")

It was agreed -- That the petition from the non-native permanent residents of Nass Valley and the Irene meadows community be filed as an exhibit with the committee. (Exhibit 5900 A1/C-9, 9 "2")

The Honourable Senator St. Germain, P.C., raised a point of order on the accuracy of the transcripts of the meeting of March 23, 2000.

After hearing arguments, the Chair ruled that the point of order was not established and that the committee work should not be delayed by the fact that the transcripts were not ready or incomplete, members having heard the evidence viva voce.

It was agreed -- That the Clerk of the committee compare the electronic transcripts with the videotape version of Mr. Nault's appearance to ensure the accuracy of the transcripts.

It was agreed -- That the committee proceed to clause-by-clause consideration of Bill C-9, An Act to give effect to the Nisga'a Final Agreement.

It was agreed -- That the preamble, title, and Clause 1 stand postponed.

It was agreed -- That clause 2 carry.

It was agreed -- That clause 3 carry.

It was agreed -- That clause 4 carry.

It was agreed -- That clause 5 carry.

It was agreed -- That clause 6 carry.

It was agreed -- That clause 7 to 27, carry, on division.

It was agreed -- That the Preamble carry.

It was agreed -- That clause 1 carry.

It was agreed -- That the title carry.

It was agreed -- That Bill C-9, carry without amendment, on division.

The committee proceeded to discuss observations to be attached to the report.

It was moved by the Honourable Senator Pearson that the proposed observation be appended to the report on Bill C-9.

After debate, the question being put on the motion, it was adopted, four Honourable Senators having abstained.

It was agreed -- That the Chair report the bill without amendment and with observations, to the Senate, on division.

At 6:43 p.m., the committee adjourned to the call of the Chair.
