The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:48 a.m., in Room 257, East Block, the Chairman, the Honourable Lorna Milne, presiding.
Members of the committee present: The Honourable Senators Beaudoin, Cools, Fraser, Joyal, P.C., Milne, Moore, Nolin, Pearson and Poy (9).
In attendance: Nancy Holmes and Marilyn Pilon, Research Officers, Law and Government Division, Research Branch, Library of Parliament.
Also in attendance: The official reporters of the Senate.
Pursuant to the Order of Reference adopted by the Senate on November 18, 1999, the Committee proceeded to study Bill S-10, An Act to amend the National Defence Act, the DNA Identification Act and the Criminal Code. (See Issue No. 3, Wednesday, December 1, 1999 for full text of the Order of Reference. )
It was agreed -- That the committee group the clauses on which there will be no amendments.
It was agreed -- That the committee proceed to clause-by-clause consideration of Bill S-10.
It was agreed -- That the title stand postponed.
The Honorable Senator Fraser moved that Bill S-10, in clause 1, be amended by: adding after line 19 on page 9 the following:
"(3) A peace officer, or any person acting under a peace officer's direction, who is authorized to take samples of bodily substances from a person by an order under section 196.14 or 196.15 or an authorization under section 196.24 may take fingerprints from the person for the purpose of the DNA Identification Act."
It was agreed -- That clause 1, as amended, carry.
It was agreed -- That clause 2 to 18 carry.
The Honorable Senator Fraser moved that Bill S-10, in Clause 19, be amended on page 18 by:
(a) replacing line 26 with the following:
"19.(1) The portion of subsection 487.06(1) of"; and
(b) adding after line 38 the following:
"(2) Section 487.06 of the Act is amended by adding the following after subsection (2):
(3) A peace officer, or any person acting under a peace officer's direction, who is authorized to take samples of bodily substances from a person by an order under section 487.051 or 487.052 or an authorization under section 487.055 or 487.091 may take fingerprints from the person for the purpose of the DNA Identification Act."
It was agreed -- That clause 19, as amended, carry.
It was agreed -- That clause 20 to 26 carry.
It was agreed -- That the title carry.
It was agreed -- That Bill S-10, as amended, be adopted.
It was agreed -- That the Chairman report the Bill, as amended, to the Senate.
At 10:55 a.m., the committee adjourned to the call of the Chair.
