The Standing Senate Committee on Transport and Communications met this day at 9:40 a.m., in room 256-S, Centre Block, the Chair, the Honourable Lise Bacon, presiding.
Members of the committee present: The Honourable Senators Adams, Bacon, Callbeck, Forrestall, Furey and Poulin (6).
In attendance: The official reporters of the Senate and Martin Brennan, Special advisor.
Pursuant to the Order of Reference adopted by the Senate on April 4, 2000, the Committee proceeded to study Bill S-17. (See Issue No. 10, Wednesday, March 1, 2000 and Tuesday, April 11, 2000 for full text of the Order of Reference).
It was agreed -- That the Committee move to clause-by-clause consideration of Bill S-17.
It was agreed -- That the title stand postponed.
It was agreed -- That clause 1 stand postponed.
It was agreed -- That clauses 2 to 28 carry.
It was moved by Senator Furey -- That Bill S-17, in Clause 29, be amended by replacing lines 4 to 15 on page 10 with the following:
"loss of life or personal injury to persons carried on a ship otherwise than under a contract of passenger carriage is the greater of
(a) 2,000,000 units of account;
(b) and 175,000 units of account multiplied by
i) the number of passengers that the ship is authorized to carry according to its certificate under Part V of the Canada Shipping Act; or
ii) if no certificate is required under that Part, the number of persons on board the ship.
(3) Subsection (2) does not apply in respect of
(a) the master of a ship, a member of a ship's crew or any other person employed or engaged in any capacity on board a ship on the business of the ship; or
(b) a person carried on board a ship other than a ship operated for a commercial or public purpose".
It was agreed -- That clause 29, as amended carry.
It was agreed -- That clauses 30 to 36 carry.
It was moved by Senator Furey -- That Bill S-17, in clause 37, be amended by replacing lines 31 to 39 on page 14 with the following:
"the same or another place in Canada, either directly or by way of a place outside Canada; and
(b) the carriage by water, otherwise than under a contract of carriage, of persons or of persons and their luggage, excluding
i) the master of a ship, a member of a ship's crew or any other person employed or engaged in any capacity
ii) a person carried on board a ship other than a ship operated for a commercial or public purpose."
It was agreed -- That clause 37, as amended carry.
It was agreed -- That clauses 38 to 131 carry.
It was agreed -- That schedule 1 carry.
It was agreed -- That schedule 2 carry.
It was agreed -- That schedule 3 carry.
It was agreed -- That schedule 4 carry.
It was agreed -- That clause 1 carry.
It was agreed -- That the Title carry.
It was agreed -- That this Bill be adopted with amendments.
It was agreed -- That the Chair report the Bill, as amended, at the next sitting of the Senate.
At 9:45 a.m., the committee adjourned to the call of the Chair.
