The Standing Senate Committee on Transport and Communications met this day at 9:57 a.m., in Room 256-S, Centre Block, the Chair, the Honourable Joan Fraser, presiding.

Members of the committee present: The Honourable Senators Adams, Callbeck, Fraser, and Johnson (4).

In attendance: Terrence Thomas and Joseph P. Dion, Research Officers, Parliamentary Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, October 24, 2002, the committee continued its examination of Bill S-8, An Act to amend the Broadcasting Act (For complete text of Order of Reference, see proceedings of the committee, Issue No. 1, dated October 29, 2002).

WITNESSES:

From the Department of Canadian Heritage:

Marc O'Sullivan, Director General, Broadcasting Policy and Innovation;

Larry Durr, Director, Broadcasting Distribution Services;

Mario Lepage, Legal Counsel.

Mr. O'Sullivan made a statement and answered questions.

At 10:30 a.m., it was agreed that the committee adjourn to the call of the Chair.

The Standing Senate Committee on Transport and Communications met this day at 11:03 a.m., in Room 256-S, Centre Block, the Chair, the Honourable Joan Fraser, presiding.

Members of the committee present: The Honourable Senators Banks, Callbeck, Chaput, Christensen, Eyton, Fraser, Johnson, Kinsella, Mahovlich, Ringuette-Maltais, and Spivak (11).

Other senator present: The Honourable Senator Day (1).

In attendance: Terrence Thomas and Joseph P. Dion, Research Officers, Parliamentary Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, October 24, 2002, the committee continued its examination of Bill S-8, An Act to amend the Broadcasting Act (For complete text of Order of Reference, see proceedings of the committee, Issue No. 1, dated October 29, 2002).

The committee resumed clause-by-clause consideration of Bill S-8, An Act to amend the Broadcasting Act.

It was agreed that clause 1 be reconsidered.

The Honourable Senator Spivak moved:

THAT Bill S-8 be amended in clause 1, on page 1, by adding after line 13 the following:

``(3) The Commission shall not make an award or order under this section pursuant to which the Corporation becomes liable for the payment of costs.''

QUE le projet de loi S-8 soit modifié, à l'article 1, à la page 1, par adjonction, après la ligne 15, de ce qui suit:

«(3) Le Conseil ne peut prendre, aux termes du présent article, une décision qui aurait pour effet de rendre la Société responsable du paiement des frais.».

After debate, the question being put on the motion, it was negatived on the following division:

The Honourable Senators: Chaput, Johnson, and Spivak — 3.

NAYS

The Honourable Senators: Banks, Callbeck, Christensen, Eyton, Kinsella, Mahovlich, and Ringuette-Maltais — 7.

ABSTENTIONS

The Honourable Senator: Fraser — 1.

It was agreed that clause 1 again carry.

It was agreed that Bill S-8 now carry, on division.

It was agreed that certain observations be appended to the committee's report on the Bill, that the Subcommittee on Agenda and Procedure be authorised to finalise the text thereof, and that the Chair then be authorised to report the Bill to the Senate.

At 11:35 a.m., it was agreed that the committee adjourn to the call of the Chair.
