The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:10 p.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Bacon, Cools, Joyal, P.C, Mercer, Milne, Ringuette and Sibbeston (8).

Other senator present: The Honourable Senator Losier-Cool (1).

In attendance: From the Library of Parliament, Margaret Young and Megan Furi, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, February 1, 2005, the committee continued its consideration of Bill C-36. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 5.)

Pursuant to the Order of Reference adopted by the Senate on Tuesday, December 7, 2004, the committee continued its consideration of Bill C-302. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 5.)

Pursuant to the Order of Reference adopted by the Senate on Tuesday, December 7, 2004, the committee continued its consideration of Bill C-304. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 5.)

WITNESSES:

Elections Canada:

Jean-Pierre Kingsley, Chief Electoral Officer;

Diane R. Davidson, Deputy Chief Electoral Officer and Chief Legal Counsel;

Rennie Molnar, Senior Director, Register and Geography.

Mr. Kingsley made an opening statement and, together with the other witnesses, answered questions.

It was agreed that a letter from Senator Joyal to Jean-Pierre Kingsley be filed as an exhibit (Exhibit 5900-1.38/L1-C- 36, C-302, C-304, 6, ``4'').

It was agreed that a letter from Jean-Pierre Kingsley to Senator Joyal be filed as an exhibit (Exhibit 5900-1.38/L1-C- 36, C-302, C-304, 6, ``5'').

At 5:35 p.m., the committee adjourned to the call of the Chair.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, December 7, 2004, the committee continued its consideration of Bill C-302. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 5.)

Pursuant to the Order of Reference adopted by the Senate on Tuesday, December 7, 2004, the committee continued its consideration of Bill C-304. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 5.)

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-36.

It was agreed that the title stand postponed.

It was agreed that clause 1 carry.

It was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

It was agreed that schedule 1 carry.

It was agreed that schedule 2 carry.

It was agreed that the title carry.

It was agreed that this bill be adopted without amendment.

It was agreed that observations be appended to the report.

It was agreed that the Chair report this bill to the Senate without amendment, but with observations.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-302.

It was moved by the Honourable Senator Milne:

That clause-by-clause consideration of Bill C-302 be dispensed with;

That Bill C-302 be deemed adopted without amendment;

That observations be appended to the report; and

That the Chair report the bill to the Senate without amendment but with observations.

The question being put on the motion, it was adopted.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-304.

It was moved by the Honourable Senator Joyal, P.C.:

That clause-by-clause consideration of Bill C-304 be dispensed with;

That Bill C-304 be deemed adopted without amendment;

That observations be appended to he report; and

That the Chair report the bill to the Senate without amendment but with observations.

The question being put on the motion, it was adopted.

At 10:55 p.m., in accordance with rule 92(f), the committee proceeded in camera to consider a draft report.

It was agreed that staff be permitted to remain during the in camera session.

It was agreed that the Steering Committee be empowered to approve the final text of the observations to Bill C-36.

It was agreed that the observations to Bills C-302 and C-304 be adopted as amended.

At 11:42 a.m., the committee adjourned to the call of the Chair.
