The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:05 p.m., in room 257, East Block, the Honourable Senator Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Bacon, Baker, P.C., Eyton, Joyal, P.C, Milne, Pearson, Ringuette and Rivest (8).

Other senator present: The Honourable Senator Callbeck (1).

In attendance: From the Library of Parliament, Margaret Young and Wade Raaflaub, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, February 22, 2005, the committee continued its consideration of Bill C-10. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 9.)

WITNESSES:

Barreau du Québec:

Lucie Joncas, ad hoc Member, Criminal Law Committee;

Nicole Dufour, Research and Legislation Services, Secretary of the Criminal Law Committee.

Ministry of the Attorney General of Ontario:

Curt Flanagan, Crown Attorney, Leeds-Grenville, and Co-Chair, Advisory Committee on Mental Heallth.

Ms. Dufour, Ms. Joncas and Mr. Flanagan each made an opening statement.

The witnesses answered questions.

It was agreed that the committee proceed to clause-by-clause consideration at the next meeting of the committee.

At 5:45 p.m., the committee adjourned to the call of the Chair.

Members of the committee present: The Honourable Senators Andreychuk, Bacon, Banks, Eyton, Joyal, P.C, Milne, Pearson and Ringuette (8).

Other senators present: The Honourable Senatorss Baker, P.C, Callbeck and Spivak (3).

In attendance: From the Library of Parliament, Margaret Young and Wade Raaflaub, Analysts.

Also in attendance: The official reporters of the Senate.

WITNESS:

Department of Justice Canada:

Catherine Kane, Senior Counsel/Director, Policy Centre for Victim Issues.

Ms. Kane made an opening statement and answered questions.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-10.

It was agreed that the title stand postponed.

It was agreed that clause 1 to 10 carry.

It was agreed that clause 11 to 21 carry.

It was agreed that clause 21 to 30 carry.

It was agreed that clause 31 to 40 carry.

It was agreed that clause 41 to 50 carry.

It was agreed that clause 51 to 60 carry.

It was agreed that clause 61 to 65 carry.

It was agreed that the title carry.

It was agreed that the bill be adopted, without amendment.

It was agreed that, in accordance with rule 92(2)(f), the committee proceed in camera to consider a draft report.

At 11:40 a.m., the committee resumed in public.

The Honourable Senator Joyal moved that the Chair report the bill, without amendment, but with observations, to the Senate.

The question being put on the motion, it was adopted.

At 11:50 a.m., the committee adjourned to the call of the Chair.
