The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:05 p.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Bacon, Chaput, Cools, Eyton, Joyal, P.C, Kinsella, Milne, Pearson, Ringuette and Sibbeston (10).

In attendance: From the Library of Parliament, Margaret Young and Robin MacKay, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Monday, May 16, 2005, the committee began its consideration of Bill C-13, An Act to amend the Criminal Code, the DNA Identification Act and the National Defence Act.

APPEARING:

The Honourable Irwin Cotler, P.C., M.P., Minister of Justice and Attorney General of Canada;

The Honourable Roy Cullen, P.C., M.P., Parliamentary Secretary to Minister of Public Safety and Emergency Preparedness.

WITNESSES:

Department of Justice Canada:

Michael E. Zigayer, Senior Counsel, Criminal Law Policy Section;

Stanley Cohen, Senior General Counsel, Human Rights Law Section.

Mr. Cotler and Mr. Cullen each made opening statements and, together with the other witnesses, answered questions.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-13.

It was agreed that the title stand postponed.

It was agreed that clause 1 to 10 carry.

It was agreed that clause 11 to 20 carry.

It was agreed that clause 21 to 31 carry.

It was agreed that the title carry.

It was agreed that the bill be adopted, without amendment.

It was agreed that the bill be reported to the Senate.

At 6:30 p.m., the committee adjourned to the call of the Chair.
