The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:03 p.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Bacon, Cools, Eyton, Joyal, P.C., Mercer, Milne, Nolin, Pearson, Ringuette, Rivest and Sibbeston (12).

Other senator present: The Honourable Senator Hervieux-Payette, P.C. (1).

In attendance: From the Library of Parliament, Margaret Young and Wade Raaflaub, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, March 10, 2005, the committee continued its consideration of Bill S-21. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 14.)

Cheryl Milne, Staff Lawyer.

The Chair made a statement.

Ms. Milne made an opening statement and answered questions.

Paul D. Faris, Executive Director and Senior Legal Counsel.

Mr. Faris submitted a brief, made an opening statement and answered questions.

It was agreed that Mr. Faris' brief be printed as an appendix. (See full text of the appendix after the evidence.)

It was agreed that the document provided by the Hon. Senator Hervieux-Payette entitled ``Evaluating the Success of Sweden's Corporal Punishment Ban'' be filed as an exhibit (Exhibit 5900-1.38/L1-S-21, 15, ``10'').

It was agreed that the document provided by the Hon. Senator Hervieux-Payette entitled ``Law Reform, Corporal Punishment and Child Abuse: The Case of Sweden'' be filed as an exhibit (Exhibit 5900-1.38/L1-S-21, 15, ``11'').

It was agreed that the document provided by the Hon. Senator Hervieux-Payette entitled ``Trends in Youth Crime and Well-Being Since the Abolition of Corporal Punishment in Sweden'' be filed as an exhibit (Exhibit 5900-1.38/L1-S- 21, 15, ``12'').

It was agreed that the document provided by the Hon. Senator Hervieux-Payette entitled ``Violence and the American Family Report of a Workshop'' be filed as an exhibit (Exhibit 5900-1.38/L1-S-21, 15, ``13'').

It was agreed that the document provided by the Hon. Senator Hervieux-Payette entitled ``nationmaster.com – Map & Graph: Countries by Crime: Murders'' be filed as an exhibit (Exhibit 5900-1.38/L1-S-21, 15, ``14'').
