The Standing Senate Committee on Legal and Constitutional Affairs met in camera this day, at 4:07 p.m., in room 257, East Block, the Chair, the Honourable Donald H. Oliver, presiding.
Members of the committee present: The Honourable Senators Baker, P.C., Bryden, Cools, Joyal, P.C., Milne, Nolin, Oliver, Rivest and Zimmer (9).
Other senator present: The Honourable Senator Andreychuk (1).
In attendance: From the Library of Parliament, Margaret Young, Analyst.
In accordance with rule 92(2)(e), the committee considered a draft agenda.
It was agreed that senators' staff be permitted to remain for the in camera meeting.
It was moved:
That the committee seek an Order of Reference to resume its study of the implications of including, in legislation, non-derogation clauses and that the Subcommittee on Agenda and Procedure be empowered to approve the text of the Order of Reference that is to be presented to the Senate.
The question being put on the motion, it was adopted.
At 4:57 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Legal and Constitutional Affairs met this day at 4:17 p.m., in room 257, East Block, the Chair, the Honourable Donald H. Oliver, presiding.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, May 31, 2006, the committee began its consideration of Bill S-202, An Act to repeal legislation that has not come into force within ten years of receiving royal assent.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, May 31, 2006, the committee continued its consideration of Bill S-202, An Act to repeal legislation that has not come into force within ten years of receiving royal assent.

Mr. Keyes made a statement and answered questions.
At 11:59 a.m., the committee proceeded to consider a draft budget.
The Honourable Senator Baker, P.C., moved that the following budget application for the study of legislation for the fiscal year ending March 31, 2007 be concurred in; and, that the Chair submit same to the Standing Committee on Internal Economy, Budgets and Administration:

All Other Expenditures | 4,000 |
TOTAL | $ 74,110 |
The question being put on the motion, it was adopted.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, May 31, 2006, the committee continued its consideration of Bill S-202, An Act to repeal legislation that has not come into force within ten years of receiving royal assent.
It was agreed that the committee proceed to clause-by-clause consideration of Bill S-202, An Act to repeal legislation that has not come into force within ten years of receiving royal assent.
It was agreed that the title stand postponed.
It was agreed that clause 1 stand postponed.
It was agreed that clause 2 carry.
It was agreed that clause 3 carry.
It was agreed that clause 4 carry.
The Chair asked whether clause 5 should carry.
It was moved by the Honourable Senator Jaffer that Bill S-202 be amended in clause 5, on page 2, by replacing, in the English version, line 5 with the following: ``provision that is necessary for the amended provision to have ef-''.
After debate, the question being put on the motion, it was adopted.
It was agreed that clause 5, as amended, carry.
It was agreed that clause 6 carry.
It was agreed that clause 1 carry.
It was agreed that the title carry.
It was agreed that the bill be adopted with amendment.
It was agreed that the Chair report the bill with amendment to the Senate.
At 10:52 a.m., the committee adjourned to the call of the Chair.
