The Standing Senate Committee on Legal and Constitutional Affairs met this day at 10:50 a.m., in room 257, East Block, the Chair, the Honourable Joan Fraser, presiding.

Members of the committee present: The Honourable Senators Baker, P.C., Fraser, Joyal, P.C., Lang, Milne, Nolin, Rivest, Wallace and Watt (9).

Other senator present: The Honourable Senator Carignan (1).

In attendance: Jennifer Bird and Robin MacKay, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, October 29, 2009, the committee began its consideration of Bill C-26, An Act to amend the Criminal Code (auto theft and trafficking in property obtained by crime).

WITNESSES:

Royal Canadian Mounted Police:

Chief Superintendent Joe Oliver, Director General, Border Integrity;

Inspector Wayne Holland, Officer in Charge of Project IMPACT.

Criminal Intelligence Service Canada:

Superintendent Michel Aubin, Director General.

Ontario Provincial Police:

Detective Sergeant Stephen Boyd, Organized Crime Enforcement Bureau.

The Honourable Senator Nolin moved that the following documents be appended to the committee proceedings:

  • the written answer provided by Michel Perron, Canadian Centre on Substance Abuse, to a question asked during the meeting of November 26, 2009 (see Appendix 5900-2.40/L1- C-15, 22 "10"); and
  • the written answer provided by Sharon Dolovich to a question asked during the meeting on October 28, 2009 (see Appendix 5900-2.40/L1-C-15, 22 "11").

The question being put on the motion, it was adopted.

The Honourable Senator Milne moved that the following material be filed as exhibits with the clerk of the committee:

  • Supplementary submission from Michel Perron, Canadian Centre on Substance Abuse — List of treatment services in Canada (Exhibit 5900-2.40/L1-C-15, 22 "17").
  • Submission from University of Victoria Student Society's Hempology 101 Club (Exhibit 5900-2.40/L1-C-15, 22 "18").
  • Supplementary submissions from Sharon Dolovich (Exhibit 5900-2.40/L1-C-15, 22 "19"):
  • Paternal Incarceration and Children's Physically Aggressive Behaviors: Evidence from the Fragile Families and Child Wellbeing Study by Christopher Wildeman;
  • Perspectives, Volume 30, Number 4 — Newsletter of the BC Association of Social Workers; and

The question being put on the motion, it was adopted.

The chair made an opening statement.

Superintendent Aubin, Chief Superintendent Oliver, Inspector Holland and Detective Sergeant Boyd each made a statement and, together, answered questions.

At 12:03 p.m., the committee adjourned to the call of the chair.
