The Standing Senate Committee on Legal and Constitutional Affairs met in camera this day, at 4:26 p.m., in room 257, East Block, the chair, the Honourable Joan Fraser, presiding.

Members of the committee present: The Honourable Senators Angus, Baker, P.C., Boisvenu, Carignan, Fraser, Joyal, P.C., Lang, Rivest, Runciman, Wallace and Watt (11).

In attendance: Jennifer Bird and Cynthia Kirkby, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Pursuant to the order of reference adopted by the Senate on Tuesday, March 16, 2010, the committee continued its study of the provisions and operation of the DNA Identification Act (S.C. 1998, c. 37). (For complete text of the order of reference, see proceedings of the committee, Issue No. 1.)

Pursuant to rule 92 (2)(f), the committee commenced its consideration of a draft report.

It was agreed that senators' staff be permitted to remain in the room during the in camera portion of today's meeting.

It was agreed that the following material be filed as exhibits with the clerk of the committee:

Response from Amarjit Chahal to a question taken on notice at the March 24, 2010 meeting relating to the DNA study. (Exhibit 5900-3.40/L1-SS-1, 7, 2,``5'')

Response from Yves (Bob) Dufour of the Laboratoire de sciences judiciaries et de medicine légale to a question taken on notice at the March 18, 2010 meeting relating to the DNA Study. (Exhibit 5900-3.40/L1-SS-1, 1, ``6'')

It was agreed that the following material be filed as exhibits with the clerk of the committee and that the letter be published as an appendix to the committee's proceedings:

Response from the Honourable Vic Toews, Minister of Public Safety, to a question taken on notice at the April 14, 2010 meeting relating to Bill S-2. (Exhibit 5900-3.40/ L1-S-2, 7, 3, ``10'')

At 6:26 p.m., the committee adjourned to the call of the chair.

Pursuant to the order of reference adopted by the Senate on Wednesday, May 26, 2010, the committee began its study of Bill S-9, An Act to amend the Criminal Code (auto theft and trafficking in property obtained by crime).

The chair made an opening statement.

The Honourable Robert Nicholson, P.C., made a statement and, together with Mr. Bartlett, answered questions.

At 5:24 p.m., the committee suspended.

At 5:30 p.m., the committee resumed.

Mr. Bartlett and Ms. Clarke answered questions.

At 5:55 p.m., the committee adjourned to the call of the chair.
