The Standing Senate Committee on Agriculture and Forestry met this day at 4:02 p.m., in room 705, Victoria Building, the chair, the Honourable Percy Mockler, presiding.

Members of the committee present: The Honourable Senators Cordy, Duffy, Eaton, Fairbairn, P.C., Mercer, Mockler, Ogilvie, Peterson, Plett, Rivard, Robichaud, P.C., and Tkachuk (12).

In attendance: Adam Thompson, Committee Clerk, Senate of Canada; Sarah Jane Fraser and Kristen E. Courtney, Analysts, Parliamentary Information and Research Service, Library of Parliament; and Mona Ishack, Communications Officer, Communications Directorate.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Thursday, December 1, 2011, the committee continued its consideration of Bill C-18, an Act to reorganize the Canadian Wheat Board and to make consequential and related amendments to certain Acts. (For complete text of the order of reference, see proceedings of the committee, Issue No. 7.)

Department of Justice Canada:

Ryan Rempel, Legal Counsel.

It was agreed that the committee proceed to clause-by-clause consideration of Bill C-18.

It was agreed that Mr. Meredith and Mr. Rempel be invited to the table and, during the consideration of Bill C-18, they answered questions from time to time.

It was agreed that the title stand postponed.

It was agreed that clause 1, which contains the short title, stand postponed.

It was agreed that clause 2 carry, on division.

The chair asked whether clause 3 shall carry.

The Honourable Senator Peterson moved:

That Bill C-18 be amended, on page 1, in clause 3, by replacing lines 12 to 14 with the following:

"3.02 (1) Two directors are appointed by the Governor in Council on the recommendation of the Minister, and two directors are appointed, despite the provisions of any other Act, by the board of directors of the Canadian Wheat Board, as constituted immediately before this section comes into force, from among the elected members of that board. The president is appointed by the".

After debate, the question being put on the motion, it was negatived on the following vote:

That Bill C-18 be amended, on page 12, in clause 14, by replacing lines 25 to 30 with the following:

"(3) The following losses sustained by the Corporation for which no other provision is made under this Act are to be paid out of moneys provided by Parliament:

(a) losses from its operations under Part 2 in relation to any pool period fixed under that Part, during that pool period; and

(b) losses from its other operations under this Act during any crop year.".

The Honourable Senator Plett raised a point of order in regards to the admissibility of the amendment.

After debate, with leave of the committee, the point of order was withdrawn.
