The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:16 p.m., in room 257, East Block, the chair, the Honourable Bob Runciman, presiding.

Members of the committee present: The Honourable Senators Baker, P.C., Batters, Boisvenu, Dagenais, Fraser, Frum, Jaffer, Joyal, P.C., McIntyre, Rivest, Runciman and White (12).

In attendance: Lyne Casavant and Julia Nichol, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Tuesday, April 16, 2013, the committee began its consideration of Bill S-16, An Act to amend the Criminal Code (contraband tobacco).

APPEARING:

The Honourable Robert Nicholson, P.C., M.P., Minister of Justice and Attorney General of Canada.

WITNESSES:

Carole Morency, Acting Director General and Senior Counsel, Criminal Law Policy Section;

Mohawk Council of Akwesasne:

Brian W. David, Chief;

Joyce King, Director of Akwesasne Mohawk Justice Department.

The chair made an opening statement.

The minister made a statement and answered questions.

At 5:01 p.m., the committee suspended.

At 5:04 p.m., the committee resumed.

Ms. Morency and Mr. Saint-Denis answered questions.

At 5:44 p.m., the committee suspended.

At 5:50 p.m., the committee resumed.

Chief David made a statement and, together with Ms. King, answered questions.

At 6:41 p.m., the committee adjourned to the call of the chair.
