The Standing Senate Committee on Human Rights met this day at 11:51 a.m., in room 9, Victoria Building, the chair, the Honourable Jim Munson, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Ataullahjan, Cowan, Frum, Hubley, Martin, Munson and Ngo (8).

In attendance: Jean-Philippe Duguay and Julian Walker, Analysts, Parliamentary Information and Research Service, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the order of reference adopted by the Senate on Wednesday, January 27, 2016, the committee continued its consideration of Bill S-201, An Act to prohibit and prevent genetic discrimination.

It was agreed that the committee proceed to clause-by-clause of Bill S-201.

It was agreed that the title stand postponed.

It was agreed that clause 1, which contains the short title, stand postponed.

After debate, it was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

The chair asked whether clause 5 shall carry.

The Honourable Senator Cowan moved:

That Bill S-201 be amended in clause 5, page 2, by replacing line 25 with the following:

"individual to collect, use or disclose the results of a''.

After debate, the question being put on the motion in amendment, it was adopted.

It was agreed that clause 5, as amended, carry.

It was agreed that clause 6 carry.

It was agreed that clause 7 carry.

It was agreed that clause 8 carry.

It was agreed that clause 9 carry.

The chair asked whether clause 10 shall carry.

The Honourable Senator Cowan moved:

That Bill S-201 be amended in clause 10, page 6, by replace lines 35 to 40 with the following:

"(3) Where the ground of discrimination is refusal of a request to undergo a genetic test or to disclose, or authorize the disclosure of, the results of a genetic test, the discrimination shall be deemed to be on the ground of genetic characteristics.''.

After debate, the question being put on the motion in amendment, it was adopted.

It was agreed that clause 10, as amended, carry.

The chair asked whether clause 11 shall carry.

After debate, clause 11 was negatived.

The chair asked whether clause 12 shall carry.

Clause 12 was negatived.

The chair asked whether clause 13 shall carry.

Clause 13 was negatived.

It was agreed that clause 1, which contains the short title, carry.

It was agreed that the title carry.

It was agreed that the bill, as amended, carry.

It was agreed that the law clerk be authorized to renumber clauses to reflect clauses that have been negatived from the bill with any cross-references to be renumbered accordingly.

After debate, it was agreed that the observations be appended to the report.

It was agreed that the Subcommittee on Agenda and Procedure be empowered to approve the final version of the observations being appended to the report taking into consideration today's discussion and with any necessary editorial, grammatical or translation changes as required.

It was agreed that Bill S-201 be reported, with amendments and observations, to the Senate.

At 12:26 p.m., the committee suspended.

At 12:31 p.m., the committee, pursuant to rule 12-16(1)(d), resumed in camera to consider a draft agenda (future business).

It was agreed that senators' staff be allowed to stay in the room.

At 1:07 p.m., the committee adjourned to the call of the chair.
