The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 505, Victoria Building, at 10:00 a.m., the Chair, the Honourable Senator Sharon Carstairs, presiding.

Members of the Committee present: The Honourable Senators Beaudoin, Carstairs, Cogger, Doody, Gigantès, Jessiman, Lewis, Milne, Nolin, Pearson, Petten and Rompkey (12).

Other senators present: The Honourable Senator Forest and the Honourable Senator Kinsella (2).

In attendance: Mollie Dunsmuir, Research Officer, Research Branch of the Library of Parliament; Laura Snowball, Research Officer, Research Branch, Library of Parliament.

Also in attendance: The official reporters of the Senate.

WITNESSES:

Kathy Brock, Professor, Political Science, Sir Wilfrid Laurier University.

Anne Bayefsky, Constitutional Lawyer, author of Canada's Constitutional Act, 1982 and Amendments; a Documentary History.

Pursuant to the Order of Reference adopted by the Senate on Thursday, June 13, 1996, the Committee commenced its consideration of the resolution to amend the Constitution of Canada, Term 17 of the Terms of Union of Newfoundland with Canada.

It was moved by the Honourable Senator Jessiman -- That the Honourable Senator Doody be elected Acting Deputy Chair of the Committee for its hearings on Term 17.

The question being put on the motion, it was agreed.

The Chair made a statement.

Professor Kathy Brock made a statement.

The Chair answered a question.

Anne Bayefsky made a statement, and, together with Kathy Brock, answered questions.

At 11:30 a.m., the committee proceeded in camera.

The committee discussed future business.

The Chair reviewed the schedule of hearings for the committee's study of Term 17.

The committee discussed potential witnesses for the hearings.

The Honourable Senator Lewis moved, -- That the following budget application be concurred in and that the Chairman submit same to the Standing Senate Committee on Internal Economy, Budgets and Administration for consideration:

Professional and Other Services $ 20,000.00
Transportation and Communications $ 90,600.00
Other Expenditures $ 7,500.00
TOTAL $ 118,100.00

The question being put on the motion, -- it was agreed.

At 11:45 a.m., the committee adjourned to the call of the Chair.
