The Standing Senate Committee on Banking, Trade and Commerce met this day, at 11:00 a.m. in Room 505, Victoria Building, the Chairman, the Honourable Michael Kirby, presiding.

Members of the committee present: The Honourable Senators Angus, Austin, P.C., Callbeck, Hervieux-Payette, P.C., Kenny, Kirby, Kroft, Meighen, Oliver, Stewart and Tkachuk (10).

In attendance: From the Parliamentary Research Branch, Library of Parliament: Mr. Anthony Jackson, Economics Division.

Also present: The official reporters of the Senate.

WITNESSES:

From the University of Toronto:

Mr. Jacob Ziegel, Professor Emeritus.

From the Congress of Union Retirees:

Mr. Larry Wagg, Vice-President; and

Ms Mary Eady, Ottawa Representative.

From the Canadian Bar Association:

Mr. J. Tim Kennish, Executive Member, Competition Law Section; and

Ms Tamra L. Thomson, Director, Legislation and Law Reform.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, November 17, 1998, the committee proceeded to study Bill C-20, An Act to amend the Competition Act and to make consequential and related amendments to other Acts. (See Issue No. 41, November 24, 1998, for the full text of the Order of Reference.)

Professor Ziegel made an opening statement and then answered questions.

Mr. Wagg made a statement and, along with Ms Eady, answered questions.

Mr. Kohos made an opening statement and then, along with Mr. Stellman, answered questions.

Mr. Kennish made an opening statement and then answered questions.

Mr. Gerry Goldstein, Director, Economics Division of the Library of Parliament, replaced Mr. Anthony G. Jackson at the meeting and the committee continued in camera to consider its report on the MacKay Task Force.

At 1:55 p.m., the committee adjourned to the call of the Chair.

Mr. Robert Lancop, Assistant Deputy Director of Investigation and Research Mergers Branch, Competition Bureau; and

Mr. François-Bernard Côté, General Counsel and Director, Legal Services.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, November 17, 1998, the committee proceeded to study Bill C-20, An Act to amend the Competition Act and to make consequential and related amendments to other Acts. Mr. von Finckenstein made an opening statement and then answered questions.

It was moved by the Honourable Senator Callbeck -- That Bill C-20 be reported without amendment. It was agreed on division.

At 12:15 p.m., the committee met in camera to discuss observations of Bill C-20.

At 12:55 p.m., Senator Callbeck moved that observations be appended to the report.

At 1:00 p.m., the committee adjourned to the call of the Chair.
