The Standing Senate Committee on Legal and Constitutional Affairs, met this day in Room 257, East Block, at 3:55 p.m., the Chair, the Honourable Lorna Milne, presiding.
Members of the committee present: The Honourable Senators Beaudoin, Bryden, Forrestall, Fraser, Grafstein, Joyal, Milne, Moore, Nolin and Rompkey. (10)
In attendance: Nancy Holmes and David Goetz, Research Officers, Research Branch, Library of Parliament.
Pursuant to the Order of Reference adopted by the Senate on Thursday, June 18, 1998, the Committee continued its consideration of Bill C-25, An Act to amend the National Defence Act and to make consequential amendments to other Acts. ( See Issue No. 33, Thursday, October 1, 1998, for full text of Order of Reference).
The Chair made a statement.
It was agreed -- That the committee complete clause-by-clause consideration of Bill C-25.
It was agreed -- That Clauses 1 to 95 carry.
It was moved by the Honourable Senator Grafstein -- That Bill C-25 be amended in Clause 96 on page 89 by replacing lines 1 to 6 with the following:
"96. (1) The Minister shall cause an independent and comprehensive review of the provisions and operation of the National Defence Act as amended by this Act, and of other legislation that governs the Department of National Defence and the Canadian Forces, to be undertaken from time to time.
(2) The Minister shall cause a report on a review conducted under subsection (1) to be laid before each House of Parliament within five years after the day on which this Act is assented to, and within every five year period following the tabling of a report under this subsection.".
After debate, it was agreed -- That the amendment be modified to read as follows:
"96. (1) The Minister shall cause an independent review of the provisions and operation of this Act to be undertaken from time to time.
The Minister shall cause the report on a review conducted under subsection (1) to be laid before each House of Parliament within five years after the day on which this Act is assented to, and within every five year period following the tabling of a report under this subsection.".
The question being put on the motion, it was agreed.
It was agreed -- That Clause 96, as amended, carry.
It was agreed -- That Clauses 97 to 128 carry.
It was agreed -- That the Title carry.
It was agreed -- That the Bill, as amended, carry.
It was agreed -- That Bill C-25 be reported to the Senate, as amended.
After debate, it was agreed -- That the Steering Committee be empowered to approve the final text of the report.
At 5:20 p.m., the committee adjourned to the call of the Chair.
