The Standing Senate Committee on Legal and Constitutional Affairs met at 4:35 p.m., this day, in room 257, East Block, the Honourable Senator Lorna Milne, Chair, presiding.

Members of the committee present: The Honourable Senators Beaudoin, Cools, Fraser, Joyal, Milne, Moore, Nolin and Pearson (8).

Other senators present: The Honourable Senators Gustafson and Kroft (2).

In attendance: From the Library of Parliament: Nancy Holmes.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, April 4, 2001, the committee proceeded to study Bill S-25, An Act to amend the Act of incorporation of the Conference of Mennonites in Canada. 

WITNESSES:

From the Conference of Mennonites in Canada:

Mr. John Lohrenz, Director of Constituency Relations.

As an individual:

Mr. Raymond du Plessis, Legislative Drafter.

Mr. Lohrenz made an opening statement and, together withMr. du Plessis, answered questions.

At 5:23 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Legal and Constitutional Affairs met at 10:45 a.m., this day, in room 257, East Block, the Honourable Senator Milne, Chair, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Beaudoin, Fraser, Milne, Moore, Nolin and Pearson (7).

Other senators present: The Honourable Senator Gustafson.

In attendance: From the Library of Parliament: Nancy Holmes.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, April 4, 2001, the committee proceeded to study Bill S-25, An Act to amend the Act of incorporation of the Conference of Mennonites in Canada. 

It was agreed, - That the Committee proceed to clause-by- clause consideration of Bill S-25.

It was agreed, - That the title stand postponed.

It was agreed, - That the preamble stand postponed.

It was agreed, - That clause 1 carry.

The Honourable Senator Moore moved, That Bill S-25 in clause 2, be amended as follows:

(a) on page 1, by replacing lines 27 to 29, with the following:

"2. Sections 1 to 5 of the Act are replaced by the following:

1. (1) The Corporation created by chapter 91 of the Statutes of Canada, 1947, is continued as a body corporate under the name "Mennonite Church Canada".

(2) The Corporation consists of those congregations of Mennonites and conferences of Mennonites that are corporate members of the Corporation on the coming into force of this Act and such other congregations of Mennonites, conferences of Mennonites or other entities as may become corporate members thereof.

2. (1) The head office of the Corporation"; and

(b) on page 2, by replacing line 6 with the following:

"3. (1) Subject to this Act, the Corpor-".

The question being put on the motion, it was - Resolved in the affirmative.

It was agreed, - That clauses 3 to 6 carry.

It was agreed, - That the preamble carry

It was agreed, - That the Title carry.

It was agreed, - That this Bill be adopted with amendment.

It was agreed, - That the Chair report this bill with amendment at the next sitting of the Senate.

At 11:25 a.m., the committee adjourned to the call of the Chair.
