The Standing Senate Committee on Banking, Trade and Commerce met this day at 11:00 a.m. in camera pursuant to Rule 92(2)(e) for the purpose of considering a draft agenda, in room 505, Victoria Building, the Chair, the Honourable Senator Kolber, presiding.

Members of the committee present: The Honourable Senators Angus, Biron, Hervieux-Payette, P.C., Kolber, Kroft, Merchant, Moore, Oliver, Prud'homme, P.C., and Tkachuk (10).

In attendance: From the Parliamentary Research Branch, Library of Parliament: Ms June Dewetering, Acting Principal, Economic Division and Mr. Yoine Goldstein, special advisor to the committee.

The committee began its examination on the administration and operation of the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act.

The committee considered its future business.

At 1:25 p.m., the committee adjourned to the call of the Chair.

In attendance: From the Parliamentary Research Branch, Library of Parliament: Ms. June Dewetering, Acting Principal, Economic Division and Mr. Yoine Goldstein, Counsel to the Committee.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October29, 2002, the committee continued its examination on the administration and operation of the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act.

Ms. Marie-Josée Thivierge, Director-General, Marketplace Framework Policy Branch;

M. Marc Mayrand, Superintendent of Bankruptcies, Office of the Superintendent of Bankruptcies;

M. Jim Buchanan, Senior Project Leader, Policy Sector;

M. Dave Stewart, Senior Project Leader, Office of the Superintendent of Bankruptcies

Mrs. Thivierge and Mr. Mayrand made a statement and with the other witnesses answered questions.

At 5:45 p.m., the committee adjourned to the call of the Chair.
