The Standing Senate Committee on Banking, Trade and Commerce met this day at 4:05 p.m., in room 505, Victoria Building, the Chair, the Honourable Senator Kolber, presiding.

Members of the committee present: The Honourable Senators Angus, Biron, Hervieux-Payette, P.C., Fitzpatrick, Kelleher, P.C., Kolber, Kroft, Moore, Oliver, Prud'homme, P.C., and Setlakwe (11).

In attendance: Mr. Yoine Goldstein, special advisor to the Committee and from the Economic Division, Parliamentary Research Branch, Library of Parliament: Ms. June Dewetering, Acting Principal and Mr. Marc-André Pigeon, Researcher.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 29, 2002, the committee continued its examination of the administration and operation of the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act.

WITNESSES:

Mr. David F. W. Cohen, Chair, National Bankruptcy and Insolvency Law Section;

Mr. Robert A. Klotz, Executive Member and Past Chair, National Bankruptcy and Insolvency Law Section;

Mr. E. Patrick Shea, Member, National Bankruptcy and Insolvency Law Section;

Ms. Tamra L. Thomson, Director, Legislation and Law Reform.

From the International Insolvency Institute:

Mr. Bruce Leonard, Chairman.

As an individual:

Mr. Bob van Leeuwen, President, van Leeuwen Engineering Limited.

Ms. Thomson, Mr. Cohen and Mr. Klotz made a statement and with Mr. Shea answered questions.

Mr. Leonard from the International Insolvency Institute made a statement and answered questions.

Mr. van Leeuwen made a statement and answered questions.

At 6:35 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Banking, Trade and Commerce met this day at 11:15 a.m. in camera pursuant to rule 92(2)(f) for the purpose of considering a draft report, in room 505 of the Victoria Building, the Chair, the Honourable Senator Kolber, presiding.

Members of the committee present: The Honourable Senators Angus, Biron, Fitzpatrick, Hervieux-Payette, P.C., Kelleher, P.C., Kolber, Moore, Oliver, Prud'homme, P.C., and Setlakwe (10).

In attendance: From the Parliamentary Research Branch, Library of Parliament: Ms. June Dewetering, Acting Principal, Economic Division.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, October 23, 2002, the committee continued its examination into the present state of the domestic and international financial system with particular emphasis on the Canadian perspective to the Enron collapse. (See Issue No. 1, October 23-24, 2002, for full text of the Order of Reference.)

Pursuant to rule 92(2)(f) the committee considered in camera a draft report.

At 12:00 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Banking, Trade and Commerce met this day at 11:10 a.m. in camera pursuant to rule 92(2)(f) for the purpose of considering a draft report, in room 505 of the Victoria Building, the Chair, the Honourable Senator Kolber, presiding.

Members of the committee present: The Honourable Senators Angus, Biron, Kelleher, P.C., Kolber, Kroft, Meighen, Moore, Oliver, Prud'homme, P.C., Setlakwe and Tkachuk (11).

In attendance: From the Parliamentary Research Branch, Library of Parliament: Ms. June Dewetering, Acting Principal, Economic Division.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, October 23, 2002, the committee continued its examination into the present state of the domestic and international financial system with particular emphasis on the Canadian perspective to the Enron collapse. (See Issue No. 1, October 23-24, 2002, for full text of the Order of Reference.)

Pursuant to rule 92(2)(f) the committee considered in camera a draft report.

It was agreed, that the draft report be referred to the Steering Committee for consideration and final approval.

The committee considered its future business.

At 1:20 p.m., the committee adjourned to the call of the Chair.

The Standing Senate Committee on Banking, Trade and Commerce met this day at 11:45 p.m., in room 505, Victoria Building, the Chair, the Honourable Senator Kolber, presiding.

Members of the committee present: The Honourable Senators Biron, Fitzpatrick, Kelleher, P.C., Kolber, Kroft, Moore, Setlakwe and Tkachuk (8).

In attendance: From the Economic Division, Parliamentary Research Branch, Library of Parliament: Ms. June Dewetering, Acting Principal.

Senator Kolber announced that he would resign as Chair of the Committee effective today, Thursday, June 19 at 5 p.m.

Senator Kolber moved — That Senator Kroft be elected Chair of the Committee effective at the time the Chair becomes vacant.

The question being put on the motion, it was — Resolved in the affirmative.

The committee considered its future business.

At 12 p.m., the committee adjourned to the call of the Chair.
