The Standing Senate Committee on Banking, Trade and Commerce met this day at 6:25 p.m., in room 505, Victoria Building, the Chair, the Honourable Richard H. Kroft, presiding.

Members of the committee present: The Honourable Senators Angus, Biron, Hervieux-Payette, P.C., Kelleher, P.C., Kroft, Massicotte, Moore and Oliver (8).

In attendance: From the Economic Division, Parliamentary Research Branch, Library of Parliament: Ms. June Dewetering, Acting Principal Division and Mr. Yoine Goldstein, Counsel to the Committee.

Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 29, 2002, the committee continued its examination of the administration and operation of the Bankruptcy and Insolvency Act and the Companies' Creditors Arrangement Act.

WITNESSES:

From the Intellectual Property Institute of Canada:

Mr. John Baker, Immediate Past President;

Mr. Warren Sprigings, Chairman of the Licensing Committee;

Mr. Rodney Kyle, Member of the Licensing Committee;

Mr. Michel Gérin, General Director.

From the Personal Insolvency Task Force:

Mr. Saul Schwartz, School of Public Policy and Administration, Carleton University;

Mr. Dave Stewart, Special Project Leader, Office of the Superintendent of Bankruptcies;

Mrs. Guylaine Houle, Litwin Boyadjian Inc.

Mr. Baker and Mr. Sprigings made a statement and with the other witnesses from the Intellectual Property Institute of Canada answered questions.

Mr. Schwartz and Mrs. Houle made a statement and with Mr. Stewart answered questions.

At 8 p.m., the committee adjourned to the call of the Chair.

Mr. Baird, Mr. Mendelsohn and Mr. Delorme made statement and answered questions.
