The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 4:50 p.m., in room 505, Victoria Building, the Honourable George J. Furey, Chair, presiding.
Members of the committee present: The Honourable Senators Andreychuk, Beaudoin, Buchanan, P.C., Cools, Corbin, Furey, Jaffer, Joyal, P.C. and Pearson (9).
Other senator present: The Honourable Senator Comeau (1).
In attendance: From the Library of Parliament, Nancy Holmes and Mollie Dunsmuir.
Also in attendance: The official reporters of the Senate.
Pursuant to the Order of Reference adopted by the Senate on Tuesday, October 8, 2002, the committee continued its study of Bill S-5, An Act respecting a National Acadian Day. (For complete text of Order of Reference see proceedings of the committee, Issue No. 2.)
It was agreed — That the committee move to clause-by-clause consideration of Bill S-5.
It was agreed — That the title stand postponed.
It was agreed — That the preamble stand postponed.
It was agreed — That clause 1, the short title stand postponed.
The Chair asked whether clause 2 shall carry.
The Honourable Senator Joyal, P.C. moved — That Bill S-5 be amended:
In clause 2, on page 1, by replacing line 20 with the following:
``2. In this Act, ``National'' means relating to all Canadians throughout Canada.
3. Throughout Canada, in each and every''.
After debate, the question being put on the motion, it was adopted.
The Committee considered the question — That clause 2, as amended, carry.
The question being put on the motion, it was adopted.
It was agreed — That clause 2, as amended, carry.
It was agreed — That clause 1 carry.
The Chair asked whether the preamble shall carry.
The Honourable Senator Joyal, P.C. moved — That Bill S-5 be amended
In the Preamble, on page 1,
(a) by replacing line 1 with the following:
``WHEREAS Acadians, in view of their origin, history and development, constitute the first permanent settlement from France in Canada and now reside in most of the provinces and territories of Canada;
WHEREAS the Acadian people have''; and
(b) by adding after line 10 the following:
``WHEREAS it is in the interest of all Canadians to be able to share in the rich historical and cultural heritage of the Acadians and to become more familiar with all its aspects, both traditional and contemporary;''.
After debate, the question being put on the motion, it was adopted.
The committee considered the question — That the preamble, as amended, carry.
The question being put on the motion, it was adopted.
With leave, the committee reverted to consideration of clause 2.
The Honourable Senator Jaffer moved — That the clause be divided.
The question being put on the motion, it was adopted.
It was agreed — That clause 2, as amended, carry.
It was agreed — That clause 3, as amended, carry.
It was agreed — That the title carry.
It was agreed — That the bill, as amended, carry.
It was agreed — That the Chair reports the bill, as amended, to the Senate.
At 5:20 p.m., the committee adjourned to the call of the Chair.
