The Standing Senate Committee on National Finance met at 9:35 a.m., this day, in room 705, Victoria Building, the Chair, the Honourable Donald H. Oliver, presiding.

Members of the committee present: The Honourable Senators Biron, Comeau, Cools, Day, Downe, Ferretti Barth, Mitchell, Murray, P.C., Oliver, Ringuette, Rompkey, P.C. and Stratton (12).

Other senators present: The Honourable Senators Massicotte, McCoy and Nancy Ruth (3).

In attendance: Guy Beaumier and Odette Madore, Research Officers, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, April 20, 2005, the committee continued its consideration of Bill C-33, A second Act to implement certain provisions of the budget tabled in Parliament on March 23, 2004 (For complete text of the Order of Reference, please see Issue No. 19 of the Proceedings of the committee).

WITNESS:

As an individual:

The Honourable Marc Lalonde, P.C.

The Chair made a statement.

Mr. Lalonde made a statement and answered questions.

After debate, it was agreed to proceed to clause-by-clause consideration of Bill C-33, A second Act to implement certain provisions of the budget tabled in Parliament on March 23, 2004.

It was agreed that the title stand postponed.

It was agreed that clause 1 (short title) stand postponed.

It was agreed that clauses 2 to 34 carry.

The Chair asked whether clause 35 shall carry.

After debate, it was agreed that clause 35 stand postponed.

It was agreed that clause 36 carry.

It was agreed that clause 37 carry.

It was agreed that clause 38 to 50 carry.

It was agreed that clause 51 carry.

The Chair asked whether clause 52 shall carry.

After debate, it was agreed that Senator Murray, P.C., read the text of his proposed amendments to clauses 52, 53 and 60 on the record.

The Honourable Senator Murray, P.C., moved:

That Bill C-33 be amended in clause 52, on page 66, by replacing lines 9 to 15 with the following:

“(4) Subsections (1) to (3) apply with respect to transactions entered into after March 22, 2004.”

After debate, the question being put on the motion, it was negatived on the following recorded division:

YEAS: The Honourable Senators Comeau, Cools, Murray and Stratton — 4.

NAYS: The Honourable Senators Biron, Day, Downe, Ferretti Barth, Mitchell, Ringuette and Rompkey — 7.

It was agreed that clause 52 carry.

The Chair asked whether clause 53 shall carry.

The Honourable Senator Murray, P.C., moved:

That Bill C-33 be amended in clause 53, on page 66, by replacing lines 21 and 22, with the following:

“(2) Subsection (1) applies to taxation years and fiscal periods that begin after 2004.”

The question being put on the motion, it was negatived.

It was agreed that clause 53 carry.

It was agreed that clause 54 carry.

It was agreed that clause 55 carry.

It was agreed that clause 56 carry.

It was agreed that clause 57 carry.

It was agreed that clause 58 carry.

It was agreed that clause 59 carry.

The Chair asked whether clause 60 shall carry.

The Honourable Senator Murray, P.C., moved:

That Bill C-33 be amended in clause 60, on page 73, by replacing lines 1 to 3, with the following:

“(2) Subsection (1) applies with respect to transactions entered into after March 22, 2004.”

The question being put on the motion, it was negatived on the following recorded division:

YEAS: The Honourable Senators Comeau, Cools, and Murray— 3.

NAYS: The Honourable Senators Biron, Day, Downe, Ferretti Barth, Mitchell, Ringuette and Rompkey — 7.

It was agreed that clause 60 carry, on division.

It was agreed that clause 61, 62, 63, 64 and 65 carry.

It was agreed that the schedule carry.

It was agreed that clause 1 (short title) carry.

It was agreed that the title carry.

The committee resumed its consideration of clause 35.

The Chair asked whether clause 35 shall carry.

After debate, it was agreed that clause 35 carry, on division.

It was agreed that the bill carry, on division.

The committee considered observations to the bill.

It was agreed that the committee not attach observations to the bill.

It was agreed that the Chair report the bill to the Senate without amendment.

The Chair made a statement about the committee's future business.

At 11:25 a.m. the committee adjourned to the call of the Chair.
