The Standing Senate Committee on Legal and Constitutional Affairs met this day, at 10:50 a.m., in room 257, East Block, the Honourable Lise Bacon, Chair, presiding.

Members of the committee present: The Honourable Senators Andreychuk, Bacon, Bryden, Cools, Joyal, P.C., Milne, Nolin, Pearson and Rivest (9).

In attendance: From the Library of Parliament: Robin MacKay and Margaret Young, Analysts.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Wednesday, June 15, 2005, the committee continued its consideration of Bill S-39. (For complete text of Order of Reference, see proceedings of the committee, Issue No. 24.)

WITNESSES:

Department of Justice Canada:

Doug Hoover, Counsel, Criminal Law Policy Section;

Bill Bartlett, Senior Counsel, Criminal Law Policy Section.

National Defence:

Colonel Dominic McAlea, Deputy Judge Advocate General/Military Justice and Administrative Law.

Mr. Hoover made a statement and answered questions.

It was agreed that Colonel Dominic McAlea from National Defence sit at the table to answer questions.

At 12:35 p.m., the committee adjourned to the call of the Chair.

Members of the committee present: The Honourable Senators Andreychuk, Bacon, Bryden, Eyton, Joyal, P.C., Milne, Mitchell, Ringuette and Rivest (9).

Pursuant to the Order of Reference adopted by the Senate on Tuesday, November 1, 2005, the committee began its consideration of Bill C-49, An Act to amend the Criminal Code (trafficking in persons).

APPEARING:

The Honourable Irwin Cotler, P.C., M.P., Minister of Justice and Attorney General of Canada.

WITNESS:

Department of Justice Canada:

Carole Morency, Senior Counsel, Criminal Law Policy Section.

Mr. Cotler made an opening statement and, together with Ms. Morency, answered questions.

It was agreed that the committee proceed immediately to clause-by-clause consideration of Bill C-49.

It was agreed that the title stand postponed.

It was agreed that clause 1 carry.

It was agreed that clause 2 carry.

It was agreed that clause 3 carry.

It was agreed that clause 4 carry.

It was agreed that clause 5 carry.

It was agreed that clause 6 carry.

It was agreed that clause 7 carry.

It was agreed that clause 8 carry.

It was agreed that the title carry.

It was agreed that the bill be adopted, without amendment.
