The Standing Senate Committee on Banking, Trade and Commerce met this day at 11:00 a.m., in room 505, Victoria Building, the Chairman, the Honourable E. Leo Kolber, presiding.
Members of the committee present: The Honourable Senators Bacon, Forrestall, Furey, Kelleher, P.C, Kolber, Kroft, Poulin, Rompkey, P.C. and Wiebe (9).
Other senator present: The Honourable Senator Mahovlich (1).
In attendance: Mr. Stephen L. Harris, and from the Parliamentary Research Branch, Library of Parliament, Economics Division: Mr. Alexandre Laurin, Research Officer.
Also present: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on Thursday, September 21, 2000, the committee proceeded to study Bill S-25, An Act to amend the Defence Production Act.
The Honourable Alfonso Gagliano made an opening statement and then, along with other witnesses answered questions.
It was agreed, -- That clause-by-clause consideration of Bill S-25 proceed.
It was agreed, -- That the title be stood.
Senator Rompkey moved, -- That clause 1 carry.
The question being put on the motion, it was adopted.
Senator Rompkey moved, -- That clause 2 carry.
The question being put on the motion, it was adopted.
Senator Rompkey moved, -- That clause 3 carry.
The question being put on the motion, it was adopted.
Senator Rompkey moved, -- That clause 4 carry.
The question being put on the motion, it was adopted.
The Chair asked whether clause 5 shall carry.
Senator Rompkey moved, -- That clause 5 be amended on page 2, by replacing, in the English version, before line 1, the title "REGULATION OF CONTROLLED GOODS" with the following:
"REGULATION OF ACCESS TO CONTROLLED GOODS".
The question being put on the motion, it was adopted.
Senator Rompkey moved, -- That clause 5 be amended on page 2, by replacing line 13 with the following:
"registration under section 39 or 39.1, knowingly ex-".
The question being put on the motion, it was adopted.
Senator Rompkey moved, -- That clause 5 be amended on page 3, by:
(a) replacing lines 21 to 23 with the following:
"39. Individuals of a class prescribed by regulation are exempt from registration.
39.1 (1) The Minister may, in accordance with the regulations, exempt an individual from registration and"; and
(b) replacing lines 33 to 35 with the following:
"(4) If an exemption is granted, the Minister shall furnish, in accordance with the regulations, a certificate of".
The question being put on the motion, it was adopted.
Senator Forrestall moved, -- That clause 5 be amended on page 4, by:
(a) replacing, in the English version, line 26 with the following:
"inspection or copying any document that"; and
(b) replacing, line 27 with the following:
"the inspector believes, on reasonable grounds, contains any in-"
After debate,
Senator Rompkey moved, -- That the amendment be amended by deleting section (b).
The question being put on the sub-amendment, it was adopted.
The question being put on the motion as amended, it was adopted.
Senator Rompkey moved, -- That clause 5 be amended on page 5, by replacing line 16 with the following:
"sections 39 and 39.1, including".
The question being put on the motion, it was adopted.
It was agreed, -- That clause 5, as amended, carry.
Senator Rompkey moved, -- That clause 6 carry.
The question being put on the motion, it was adopted.
Senator Forrestall moved, -- That clause 7 be amended on page 7, by replacing line 35 with the following:
"section 46, the schedule set out in the".
The question being put on the motion, it was adopted.
It was agreed, -- That clause 7, as amended, carry.
Senator Rompkey moved, -- That clause 8 carry.
The question being put on the motion, it was adopted.
Senator Rompkey moved, -- That the schedule carry.
The question being put on the motion, it was adopted.
It was agreed, -- That the Title carry.
It was agreed, -- That Bill S-25 carry.
It was agreed, -- That Bill S-25 be reported to the Senate with amendments.
At 12:00 p.m., the committee considered its future business in camera.
