The Standing Senate Committee on National Finance met at 6:18 p.m, this day, in room 705, Victoria Building, the Chair, the Honourable Senator Murray, P.C., presiding.

Members of the committee present: The Honourable Senators Beaudoin, Biron, Comeau, Day, Ferretti Barth, Finnerty, Gauthier, Kelleher, P.C., Mahovlich, Merchant, Moore and Murray, P.C. (12).

In attendance: Mr. Guy Beaumier, and Stephen Laurent, Research Officers, Library of Parliament.

Also in attendance: The official reporters of the Senate.

Pursuant to the Order of Reference adopted by the Senate on June 4, 2003, the committee continued consideration of Bill C-28, An Act to implement certain provisions of the budget tabled in Parliament on February 18, 2003.

APPEARING:

Mr. Bryon Wilfert, M.P., Parliamentary Secretary to the Minister of Finance.

WITNESSES:

Mr. Yvan Roy, Assistant Deputy Minister, Law Branch;

Mr. Peter DeVries, Director, Fiscal Policy Division, Economic and Fiscal Policy Branch;

Mr. Glenn R. Campbell, Chief, CHST and Policy Development, Federal-Provincial Relations and Social Policy Branch.

Mr. Gérard Lalonde, Senior Chief, Tax Legislation Division, Tax Policy Branch.

Mr. Bryon Wilfert made an opening statement and, with Mr. Roy and Mr. DeVries, answered questions from members of the committee.

It was agreed to move to clause-by-clause consideration of the Bill.

It was agreed to proceed by considering the groups of clauses in each part of the bill.

It was agreed to stand the title and clause 1 of the bill.

It was agreed that clause 2 carry.

It was agreed that clauses 3 to 8 carry.

It was agreed that clauses 9 to 14 carry.

It was agreed that clauses 15 to 30 carry.

It was agreed that clauses 31 to 43 carry.

It was agreed that clause 44 carry.

It was agreed that clauses 45 to 60 carry.

It was moved by the Honourable Senator Beaudoin that clause 64 be amended on page 55,

(a) by replacing line 19 with the following:

"into force on December 17, 1990, except in respect of cases in which school authorities and lawyers representing Her Majesty the Queen in right of Canada have agreed to file consents to judgment before the appropriate court.''; and

(b) by deleting lines 20 to 39.

The question being put on the motion, it was rejected on the following division:

YEAS

Beaudoin, Comeau, Kelleher, Moore (4).

NAYS

Biron, Day, Ferretti Barth, Finnerty, Gauthier, Mahovlich, Merchant (7).

ABSTENTION

Murray (1).

It was agreed that clauses 61 to 66 carry on division.

It was agreed that clauses 67 and 68 carry.

It was agreed that clauses 69 to 90 carry.

It was agreed that clauses 91 to 130 carry.

It was agreed that the Schedule carry.

It was agreed that clause 1 carry.

It was agreed that the title carry.

It was agreed that the Bill carry on division.

It was agreed that the Chairman report the Bill without amendment to the Senate.

At 8:01 p.m., the committee adjourned to the call of the Chair.
